In India, a trademark registration remains valid for 10 years from the date of application, and it can be renewed indefinitely every 10 years. Missing a renewal deadline could lead to extra surcharges, restoration costs, or even loss of your rights — but fortunately, there are grace periods and options available.

• MSME/Startup discounts on application fees don’t apply to renewal surcharges.

• Renewal Within Grace Period: You have a 6-month grace period after expiry where you can renew your trademark by paying the standard renewal fee plus the applicable surcharge.


• Restoration After Removal: If you miss both the renewal window and grace period, your trademark is removed from the register. However, you can still restore it within 1 year from expiry by:
  Filing Form TM-R
  Paying both the standard renewal fee and the restoration fee
  Providing a valid justification for the delay
  
  Registrar’s Discretion: Approval of restoration lies with the Registrar of Trademarks, so always provide a genuine reason.
